The Empire Gold claim is a 20-acre unpatented placer mining claim at about 10,000 feet in altitude on the prolific Big Union Creek in the San Isabel National Forest of Colorado. About a 10-mile / 20 minute drive (2-wheel, no 4x4 needed) south of the historic mining town of Leadville CO, this claim is in one of the top producing districts in all of Colorado - and it doesn’t get much more picturesque either. With a short drive to civilization for supplies and lodging, you have the best of both worlds on this claim - remote yet not so far away that you can’t be comfortable. Big Union Creek runs between 10 and 40 feet from the road (County Road 7 off of Highway 24 out of Leadville) depending on where you are on the claim, so access is fairly easy. Although it is fairly well wooded in this area and there is a good amount of brush, it’s not too thick in here, so you can get to just about the entire portion of the creek that runs through your 20 acres claim. A little bushwhacking and limb cutting will open up the last 15% or so of the creek that may be a little overgrown. You will have 1,425 feet of the creek here to work at your leisure! Come to Hike, Camp, Ride and Shoot - or come to pull some shiny rock$ out of the ground;-) Note that winter is going to make mining almost impossible on this claim due to snowfall at this altitude and of course the freezing of the ground and most of the creek itself. Although this road is sometimes maintained and plowed year round due to a number of active claims on the other side of the pass, it will most likely be inaccessible without some serious work after a storm anyway. But during the late spring, summer and early fall, even when it rains, the road is a fairly well graded and you will not need 4-wheel drive. The creek ranges from about 4 to 12 feet wide and I would estimate it is between 12 and 36 inches deep in most spots. Expect the width and depth to almost double (and sometimes triple) during the spring melt/run-off. Due to the significant amount of snowfall on the peaks surrounding your claim, the annual spring melt / runoff will usually cause the creek to overflow its banks and that is when new material from the source (lode) up in the peaks will be redeposited into this portion of the creek every year. So there is an excellent chance of finding new placer gold here each and every year that you come back. There’s no place to really camp with an RV on the claim, other than just pulling off to the side of the road - which I really wouldn’t recommend, but there is dispersed camping allowed in the area, and you will find some nice spots for a small camper or very small trailer nearby. And if roughing it is your style and you’d rather not stay at one of the RV parks or hotels in Leadville, then there are plenty of great spots right next to the creek to tent camp all along the creek/claim if you don’t mind walking in to them. You will find that the creek has a number of bends and twists as well as some nice gravel bars to trap the heavier gold, so there are a number of real promising places to work your claim all along the entire length of the creek. Under Federal law in order to occupy the public lands under the mining laws for more than 14 calendar days in any 90 day period, a claimant must be involved in certain activities that (a) are reasonably incident; (b) constitute substantially regular work; (c) are reasonably calculated to lead to the extraction and beneficiation of minerals; (d) involve observable on-the-ground activity that can be verified; and (e) use appropriate equipment that is presently operable, subject to the need for reasonable assembly, maintenance, repair or fabrication of replacement parts. All five of these requirements must be met for occupancy to be permissible. Although it is possible to build a permanent structure on a mining claim, it is extremely expensive and you will have to jump through way too many hoops to consider it easy to do. It would have to be in support of a commercial, year-round mining operation for starters, and you would need to post a large reclamation bond to insure that if you ever abandoned your claim, the bond would pay for the removal of the structure and the reclamation or the area. So in short, it is technically possible to build on your mining claim, but just be aware that it is very difficult and expensive to do - however, camping is almost always involved unless your claim is in a wilderness area, which is not very common at all.
